1. Acceptance of Terms

By accessing or using SparkDev ("we", "us", "our") services at sparkdev.in, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services Provided

SparkDev offers digital and custom software engineering solutions including:

• Custom web development (websites, custom business dashboards, portfolio layouts, landing pages)
• Discord bot development and deployment configurations
• Minecraft server plugins and architectural configuration
• Managed hosting solutions via SparkNode
• Free subdomain provisioning (*.sparkdev.in)
• Digital consulting, site performance analysis, and custom software projects

3. User Accounts

To access certain interactive features, you must authenticate via Discord OAuth. You are responsible for maintaining the security of your account session. We reserve the right to suspend or terminate accounts that violate these terms, exploit system resources, or engage in fraudulent activity.

4. Orders & Payments

All prices are listed in INR (Indian Rupees) unless stated otherwise. Payments are processed securely via our integration partner, Razorpay. Orders are officially confirmed only upon receipt of full payment or explicit written project agreements. Project timelines begin strictly after payment confirmation and receipt of all required client-side materials.

5. Refunds, Cancellations & Project Scope

All payment transactions are bound by our standalone Refund Policy.

• Digital Products & Hosting: Because our solutions consist of custom digital code delivery and real-time server resource allocations, all sales are final once digital assets are delivered or SparkNode hosting resources are provisioned.
• Included Revisions: Every custom website development, dashboard configuration, or bot build includes a minimum of one (1) standard design revision cycle at no extra cost.
• Additional Revisions: Any additional revision workflows beyond the initial cycle will be explicitly stated inside the product description or separate contract scope. Revisions requested outside of these terms will incur standard hourly development charges.
• Scope Changes: Core changes to project functionality made after a project has kicked off will result in an adjustment to the original quote and billing timeline.

6. Intellectual Property

Upon full payment clearance, clients receive ownership of custom design deliverables explicitly created for their project. SparkDev retains complete ownership of:

• Internal tools, base frameworks, and reusable code libraries used during development.
• Any pre-existing SparkDev intellectual property incorporated into projects.
• The SparkDev brand, logos, and platform infrastructure.

7. Acceptable Use & Subdomains

Free subdomains (*.sparkdev.in) and hosting allocations are provided at our absolute discretion and may be revoked without notice if misused. You agree not to use our infrastructure for illegal activities, harassment, spamming, phishing, distributing malware, or circumventing platform rate limits.

8. Limitation of Liability

SparkDev shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. We do not guarantee 100% uninterrupted uptime for hosting services; scheduled system maintenance and force majeure events are excluded from standard uptime commitments. Our total liability shall not exceed the amount paid for the specific service giving rise to a claim.

9. Governing Law

These terms are governed by the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
