Terms of Service

1. Acceptance of Terms

By accessing or using SparkDev ("we", "us", "our") services at sparkdev.in, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services Provided

SparkDev offers the following services:

• Custom web development (websites, web apps, landing pages)
• Discord bot development and deployment
• Minecraft server plugins and configuration
• Hosting solutions via SparkNode
• Free subdomain provisioning (*.sparkdev.in)
• Digital consulting and custom software projects

3. User Accounts

To access certain features, you must authenticate via Discord OAuth. You are responsible for maintaining the security of your account and all activities under it. You must not share credentials or impersonate others.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Orders & Payments

• All prices are listed in INR (Indian Rupees) unless stated otherwise.
• Payments are processed securely via Razorpay.
• Orders are confirmed only upon full payment or written agreement.
• Project timelines begin after confirmation and receipt of all required materials from the client.
• Scope changes after project start may incur additional charges.

5. Refunds & Cancellations

Please refer to our Refund Policy for detailed information on cancellations and refunds. In general:

• Digital services that have been delivered are non-refundable.
• Refunds may be issued at our discretion for incomplete or defective work.
• Hosting services are non-refundable once provisioned.

6. Intellectual Property

Upon full payment, clients receive ownership of deliverables specifically created for their project. SparkDev retains ownership of:

• Internal tools, frameworks, and reusable code libraries used in development
• Any pre-existing SparkDev intellectual property incorporated into projects
• The SparkDev brand, logos, and platform infrastructure

7. Acceptable Use

You agree not to use our services for:

• Illegal activities or violation of applicable laws
• Harassment, hate speech, or harmful content
• Spam, phishing, or unauthorized data collection
• Distributing malware or conducting cyberattacks
• Circumventing platform restrictions or rate limits

Violation of these terms may result in immediate account termination without refund.

8. Subdomains

Free subdomains (*.sparkdev.in) are provided at our discretion and may be revoked if misused. Subdomains must not be used for illegal, harmful, or spam purposes. We reserve the right to reclaim any subdomain without prior notice if it violates these terms.

9. Limitation of Liability

SparkDev shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

We do not guarantee 100% uptime for hosting services. Scheduled maintenance and force majeure events are excluded from SLA commitments.

10. Governing Law

These terms are governed by the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of courts in India.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be notified via our platform. Continued use after changes constitutes acceptance.
